Terms of Service

Welcome to Tater! These Terms of Service ("Terms") govern your use of the Tater mobile application ("App") operated by Tater ("we", "our", or "us"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Tater. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information when creating your account.
  • You may not create multiple accounts, impersonate others, or use misleading usernames.

3. Acceptable Use & Community Guidelines

Tater is a social platform built on fun, creativity, and community. To keep it that way, you agree not to:

3.1 Prohibited Content

  • Post hate speech, slurs, or content that targets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Post threats, harassment, bullying, or intimidation of any kind
  • Post sexually explicit or pornographic content
  • Post violent, graphic, or disturbing content
  • Post illegal content, promote illegal activities, or facilitate illegal transactions
  • Post spam, scams, phishing, or misleading content
  • Post personal information about others without their consent (doxxing)

3.2 Prohibited Behavior

  • Manipulate gameplay mechanics through bots, scripts, or automated tools
  • Exploit bugs or vulnerabilities (please report them to us instead)
  • Create fake accounts or engage in coordinated inauthentic behavior
  • Interfere with other users' enjoyment of the App
  • Attempt to reverse-engineer, decompile, or hack the App or its servers
  • Circumvent rate limits, bans, or other restrictions

4. Content Ownership & License

4.1 Your Content

You retain ownership of the content you create and upload to Tater (potato names, stories, photos, captions, and comments). By posting content, you grant Tater a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your content within the App and for promotional purposes (such as featuring popular chains on social media or marketing materials).

4.2 Content Removal

We reserve the right to remove any content that violates these Terms or our Community Guidelines without notice. You may delete your own content at any time, though content that has been shared as part of a potato chain may remain visible to other chain participants.

4.3 Content Moderation

We use a combination of automated tools (image moderation) and user reporting to identify content that violates our guidelines. Flagged content may be removed and repeat violators may have their accounts suspended or terminated.

5. Virtual Currency (Sprouts)

5.1 Nature of Sprouts

Sprouts are a virtual currency used within Tater for in-game actions such as reviving expired potatoes. Sprouts:

  • Have no real-world monetary value
  • Cannot be exchanged for real currency, goods, or services outside the App
  • Cannot be transferred between accounts
  • Cannot be refunded once purchased, except as required by applicable law or platform policies (Apple App Store, Google Play Store)

5.2 Sprout Pricing

The pricing of sprout packages is displayed in the App and processed through Apple App Store or Google Play Store. All purchases are subject to the respective platform's terms and refund policies.

5.3 Earned Sprouts

Sprouts earned through gameplay (passing potatoes, participating in chains, etc.) are granted at our discretion and may be adjusted as we balance the game economy.

6. Game Rules

  • Potatoes expire on a timer. Failure to pass a potato before it expires results in the potato's death.
  • Expired potatoes can be revived using sprouts within a limited window (72 hours). After that, the potato is permanently dead.
  • You may hold a maximum of 10 potatoes at a time.
  • We reserve the right to adjust game mechanics, timers, costs, and rules at any time to maintain balance and fairness.

7. Account Suspension & Termination

We may suspend or terminate your account if you:

  • Violate these Terms or our Community Guidelines
  • Engage in abusive, fraudulent, or harmful behavior
  • Are the subject of repeated content reports from other users
  • Attempt to manipulate or exploit the App

Upon termination, you lose access to your account and any associated sprouts. Potatoes you are holding will expire as normal. We may, at our discretion, provide notice before termination for minor violations.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • Our total liability to you for any claim arising from these Terms or the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.
  • We are not responsible for the loss of virtual currency, potatoes, or game progress due to technical issues, bugs, or service interruptions.

9. Indemnification

You agree to indemnify and hold Tater harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your content, or your violation of these Terms.

10. Intellectual Property

The Tater name, logo, design, and all original content created by us are our intellectual property. You may not use our branding without written permission. The App's code, design, and game mechanics are protected by copyright and other intellectual property laws.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
